TERMS AND CONDITIONS OF SALE DIGITAL BURBERRY EMPLOYEE SALE
TERMS AND CONDITIONS APPLICABLE TO EMPLOYEES
GENERAL CONDITIONS
• The Digital Burberry Employee Sale will take place from Monday 1st April 2024 – Monday 31st March 2025 and will be accessible via the following link https://it. employeestore.burberry.com.
• PLEASE BE AWARE some products offered in this Digital Employee Sale will include minor imperfections, such as scratches, tarnishing, or other minor markings and/or defects. These imperfections should not materially detract from the relevant product’s purpose; however ANY DEFECTS WILL NOT BE SHOWN ON THE RELEVANT PRODUCT PAGE. This will not affect your statutory rights.
• Burberry online sales for employees represent an opportunity for employees to purchase Burberry products at discounted prices. No other employee discounts apply.
• By participating in the Digital Burberry Employee Sale, employees (hereinafter also referred to as the "Employee") agree to be bound by the following terms and conditions (including any additional terms, conditions and policies set forth below).
• The Digital Burberry Employee Sale can only be accessed using the email address of a Burberry employee. Employees are not allowed to share their access data under any circumstances. The sharing or dissemination of access data may result in disciplinary action, up to dismissal, according to the applicable legal provisions.
• It is possible to spend a total of up to 9,000.00 Euros per year on all sample sales for employees (whether digital, physical and/or virtual) held during the same year. For these purposes, "year" means from 1 April to 31 March. The Employee is responsible for ensuring that this spending limit is not exceeded. If Employees exceed this limit, they may face cancellation of orders that have not yet been shipped, may be unable to make further purchases during the sale and for future sales, and may be subject to disciplinary action up to and including termination, subject to applicable law. In addition, any expenses deemed unusual will be reviewed and evaluated on a case-by-case basis. Note that this spending limit does not also include shipping costs and takes into account refunds as a result of returns by employees. For example, if you have spent €8,999.00 and wish to make another purchase, you will need to return enough items and wait for the return to be processed before you can make any further purchases.
• Purchases at the Digital Burberry Employee Sale are not included in the annual spending limit for employee discounts. If you have any questions regarding the Employee Discount Policy and Spending Limit, please email us at employee.discount@burberry.com.
• Item sales will be handled based on the quantities of items available. Employees may purchase only the following maximum number of items per quarter (Q1: April - June, Q2: July - September, Q3 October - December, Q4 - January, March):
5 bags, including suitcases
5 small accessories, e.g. wallets, purses, card holders
5 Heritage overcoats
10 scarves
5 units of any other product bearing the same item code, regardless of size.
Employees must ensure that they do not exceed the above limitations on the products that can be purchased. Please note that the limits on the products that can be purchased take into account refunds as a result of returns by employees. For example, if an Employee has purchased 5 bags and wishes to purchase another bag in the same quarter, they must return one bag (if any) and wait for the return to be processed before they can purchase another bag. If Employees exceed these limits, they may have orders not yet shipped cancelled, they may be unable to make further purchases during the sale and for all future sales, and they may be subject to disciplinary action up to and including termination, subject to applicable law.
• Items purchased are intended for personal use only, they may also be intended for the use of the Employee's family members (parents/ adopted parents / spouse/ partner/ siblings/ children/ step-children), or as a personal gift from the employee to someone else for which they are not reimbursed. Only members of the Employee's family may reimburse the Employee for items purchased for personal use. Except where a family member has been authorised by Burberry to access the Digital Burberry Employee Sale, the Employee's family members may not gift the products from the Digital Burberry Employee Sale to any third party.
• Employees are strictly prohibited from reselling items purchased during the Digital Burberry Employee Sale, and reselling the items may result in disciplinary action up to and including termination in accordance with applicable law. Employees suspected of posting items from the Digital Burberry Employee Sale on WeChat, eBay or similar sites will be subject to a disciplinary investigation and their line managers will be informed.
TERMS AND CONDITIONS OF SALE FOR EMPLOYEES
• These terms and conditions ("Terms and Conditions") govern any contract for the sale of items entered into on the Digital Burberry Employee Sale website between the Employee and Burberry Italy S.R.L. ("Burberry", "We").
• The Digital Burberry Employee Sale Terms and Conditions will apply to all purchases made on the https://it. employeestore.burberry.com.
• Please check that you have read and fully understood the Digital Burberry Employee Sale Terms and Conditions. You will be asked to accept these Terms and Conditions before placing an order on the Digital Burberry Employee Sale website. If the Employee does not agree to these Terms and Conditions, no items from the Digital Burberry Employee Sale may be purchased.
• The contract between the Employee and Burberry for the sale of items on the Digital Burberry Employee Sale website is concluded when the Employee places the order for the item by clicking on the "payment" button on the corresponding web page.
• At the time of conclusion of the contract of sale, A confirmation email will be sent to the Employee with information about the completed transaction.
Eligibility
• The Digital Burberry Employee Sale is only open to Employees who: (i) are employed in Italy (ii) reside in Italy (iii) have not been informed of the suspension of their employee discount; and (iv) are not suspended pending investigation into alleged abuse of the employee discount.
• The Digital Burberry Employee Sale is only accessible to Burberry Employees who use their Burberry employee email address.
• To access the Digital Burberry Employee Sale you must Invite two people who are family or friends. For more information on how to participate, see the "Invite family and friends" section.
• The Employee is invited to pay attention to the deadline to invite family or friends; if the deadline is not met, it will not be possible to access the sale
Etiquette
• Please do not post on social media or other customer experience platforms, feedback or sites regarding the Digital Burberry Employee Sale.
Please note that:
- any breach of these Terms and Conditions (or any other terms applicable to the Digital Burberry Employee Sale); and/or any communication to Burberry Customer Service and/or ITDigitalEmployeeSale@burberry.com deemed by Burberry to be abusive, rude or otherwise inappropriate, may result in disciplinary action up to and including termination, cancellation of any order not yet shipped and/or denial of access to this sale or any future sale.
Payments
• The delivery time for all orders is 14 business days.
• The Employee shall pay the price for each item purchased (including VAT, or other taxes that may be applicable), the cost of any additional services requested by the Employee (e.g., additional costs for personalized items) if applicable, and the related shipping costs as provided in the "shipping and handling" section below.
• Payment will be made only after that the Employee has completed the order, accepted these Terms and Conditions and clicked on the relevant "payment" button on the web page. In the event that the order or any part of it cannot be dispatched for any reason, Burberry will notify the Employee of such circumstance and the balance will be refunded within 7 working days from the date of cancellation/modification of the order (as applicable).
• In the event that payment fails for any reason, Burberry will proceed to cancel the order and will notify the Employee in writing at the email address provided during user registration.
Shipping & Packaging
• Purchases made under the Digital Burberry Employee Sale may only be made using standard shipping and standard packaging.
• Shipping costs incurred in purchasing items through the Digital Burberry Employee Sale are the responsibility of the Employee. The cost of shipping costs will be €10 per order and as summarized at checkout.
• Employees are advised that items purchased at the Digital Burberry Employee Sale cannot be shipped outside of Italy.
• Orders can only be shipped to one address for each sale made, any order sent to a Burberry location such as an office, A store or factory will be cancelled.
• Only one delivery address can be used for the duration of the Digital Burberry Employee Sale. The "In-store pickup" delivery method will not be available.
Additional terms & conditions
1. The sale of items will be handled according to the limited quantities of items available. Burberry reserves the right to limit the number of items purchased per individual. Employees may not spend more than €9,000.00 between April 1, 2024 and March 31, 2025 on any employee sale. It is the responsibility of the Employees to ensure that they do not exceed this spending limit. If Employees exceed this limit, they may incur the cancellation of orders that have not yet been shipped, may be unable to make further purchases during the sale and for future sales, and may also be subject to disciplinary action up to and including termination, subject to applicable legal provisions, and the respective line manager will be notified. In addition, any expenses deemed unusual will be reviewed and assessed on a case-by-case basis.
2. Products purchased at the Digital Burberry Employee Sale are not eligible for Burberry Aftercare. This circumstance does not affect the rights provided by law for Employees.
3. Products purchased during the Digital Burberry Employee Sale cannot be the subject of a tax recovery claim.
4. Burberry gift cards are not accepted as a payment method at the Burberry Digital Employee Sale.
5. Employees who fail to comply with these Terms and Conditions may be excluded from access to the Burberry Digital Employee Sale now and in the future, may incur the cancellation of orders that have not yet been dispatched and may also be subject to disciplinary action up to and including dismissal, subject to applicable legal provisions, and the respective line manager will be notified.
6. Items on offer as part of the Digital Burberry Employee Sale may have the original price on the receipt. This price represents the price at which the product or a similar product was originally offered for sale in Burberry stores, online or in warehouses around the world, or is an estimate of the price at which the product would have been offered for sale in our stores. The original price is shown for comparison purposes only.
7. Burberry reserves the right, in its sole discretion, to amend the Digital Burberry Employee Sale Terms and Conditions at any time. Any changes or updates we make to these Terms and Conditions will apply to all future orders you place with us when you order new items as part of the Digital Burberry Employee Sale. We will always post the most current version of these Terms and Conditions on the it.employeestore.burberry.com website and will clearly display the date to highlight the date of the changes made.
APPLICABLE LAW AND JURISDICTION
• These Terms and Conditions are governed by and shall be construed in accordance with Italian law.
• Any dispute arising out of, or relating to, these Terms and Conditions shall be subject to the jurisdiction of the court of your residence or domicile.
• Employees may access the European Online Dispute Resolution Platform provided by the European Commission and available at http://ec.europa.eu/odr , for the alternative out-of-court resolution of disputes that cannot be resolved between Employees and Burberry.
Digital Burberry Employee Sale purchase of exotic products
The Convention on International Trade in Endangered Species of Wild Fauna and Flora (CITES) is an agreement between governments that regulates international trade in specimens of certain wild animals and plants.
• Burberry fully supports the conservation of species whose trade is regulated by CITES and complies with all national and international regulations.
• In accordance with international and EU regulations, Travellers crossing international borders require a CITES permit.
• CITES-regulated exotic items sold during the Digital Burberry Employee Sale will not be CITES-authorised.
• It is the responsibility of Employees to be aware of and comply with CITES and any other wildlife trade regulations in force in the country you are entering or leaving.
• Please check the requirements of each country before attempting to bring the item purchased across national borders.
